McCabe's case

     Matthew McCabe, the Navy Seal who is accused of hitting a terrorist, is set to go on trial in Virginia tomorrow. In light of the 2 other Seals being acquitted, there is hope that Matt will be acquitted. It is unknown at this time whether this case will be going in front of a jury or simply a judge. The case is that the terrorist testified with embellishments (lies) but the Petty Officer who has accused McCabe was inconsistent in his accusations.There is concern over the fairness of McCabe's trial because 5 witnesses who support McCabe were not initially given immunity to testify, although that changed in March.
     Interestingly, the terrorist who accused McCabe was not deposed. Accusations have been made that the accusing officer Petty Officer 3rd Class Kevin DeMartino has issued a changing inconsistent story concerning the charges he made against McCabe.

Since those two military judge’s rulings, Major General Cleveland has canceled the government trip to Iraq to depose the detainee.   This leaves the SO2 McCabe defense and government teams without the Iraqi detainee’s presence or sworn statements as evidence in the case

In addition, there is suspicion about the terrorist's statements since part of AQ's training of its members is to lie and make up stories about how harshly you were treated.

In an article on The US Report, writer Chris Carter opines that the case of the prosecution against McCabe, Huertas and Keefe “appears weak.” Carter continues by pointing out the stipulation in the Al Qaeda training manual instructing captured members to complain of abuse as well as the SEALs’ decision to undergo a trial to clear their name and protect their careers.
