I'm sure the Supreme Court justices have plenty of friends who keep them updated on the latest news surrounding cases before them. Probably they are unwillingly subjected to a barrage of email linked news and web videos from friend and relatives. In other words they know what going on. So it must have given them cause to wonder why the Obama administration would send a dork to Capitol Hill to gut the administration's position on the individual mandate in Obamacare. The Justice Department has argued that the penalty an individual who failed to purchase health insurance would incur is a tax and a perfectly constitutional function of government.
Testifying before Congress President Obama's acting budget director Jeffrey Zients shot down that argument.
